Terms of Service

01 Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By creating an account you confirm that you are.

02 Your account

• You are responsible for keeping your account credentials confidential.
• You are responsible for everything that happens under your account.
• Give us accurate information when you sign up, and keep it current.
• Tell us immediately at joe@growthmastery.ai if you suspect someone else has access to your account.

03 Acceptable use

We built this to help people share a real gift with the world. You agree not to use the Service to:

• Violate any law, regulation, or third-party right.
• Send spam, unsolicited messages, or deceptive content.
• Message anyone by email or SMS who has not consented to hear from you, or continue messaging anyone who has asked you to stop.
• Upload or distribute malware, viruses, or harmful code.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Scrape, crawl, or use automated means to access the Service without permission.
• Interfere with or disrupt the Service or the servers connected to it.
• Impersonate any person or entity.
• Create content that is illegal, defamatory, harassing, or that infringes intellectual property rights.

We may suspend or terminate accounts that violate these terms.

04 Trial, billing, and cancellation

• The free trial runs seven days. We collect a payment method at signup and, unless you cancel before the trial ends, the subscription converts automatically to the paid plan at the rate shown at signup.
• Billing runs through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
• All fees are in US dollars unless stated otherwise.
• Cancel any time. Cancellation takes effect at the end of the billing period you have already paid for - you keep access until then, and we do not issue partial refunds for unused time.
• We may change pricing with 30 days' notice. Continuing to use the Service after a price change means you accept it.
• If a payment fails we may suspend access to paid features until the balance is resolved.
• Done-for-you engagements and other one-time services are governed by the written scope and payment schedule agreed for that engagement, which prevails over this section where the two differ.

05 Who owns what

5.1 Our property

The Service - its design, code, branding, logos, and documentation - is owned by GrowthMastery.ai and protected by intellectual property law. You may not copy, modify, distribute, or reverse-engineer any part of it.

5.2 Your content

You own what you create with the Service - your funnels, copy, images, and campaigns. By uploading content you grant us a limited license to host, display, and process it for the sole purpose of providing the Service to you. That license ends when you delete the content or close your account.

5.3 AI-generated content

Content produced by the AI features is provided as-is. You are responsible for reviewing and editing it before you use it. We make no guarantee about the accuracy, originality, or legal compliance of AI output - human judgment sits on top of this system by design, and that human is you.

06 Third-party integrations

The Service connects to third-party platforms including Meta (Facebook and Instagram), Google, Stripe, and others. Your use of those integrations is also governed by each provider's own terms. We are not responsible for the availability, accuracy, or practices of third-party services.

07 Limitation of liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
• Our total liability for any claim related to the Service will not exceed what you paid us in the 12 months before the claim.

08 Indemnification

You agree to indemnify and hold harmless GrowthMastery.ai, its operator, and its affiliates from any claim, damage, loss, or expense (including reasonable attorney's fees) arising from your use of the Service, your breach of these Terms, or your violation of anyone else's rights.

09 Termination

• By you: close your account at any time from account settings, or by contacting us.
• By us: we may suspend or terminate your account if you breach these Terms, engage in fraud, or if the law requires it. We will make reasonable efforts to warn you first.
• On termination your right to use the Service ends immediately. We may delete your account data within 30 days, subject to legal retention requirements. Export anything you want to keep before you go - and just ask if you need help doing it.

10 Dispute resolution

Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation. If that fails, it will be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in the State of Texas, USA. Each party bears its own costs unless the arbitrator decides otherwise.

11 Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.

12 Changes to these terms

We may update these Terms. We will post the revised version here and update the "Last updated" date, and we will notify you of material changes. Continuing to use the Service after a change means you accept the revised Terms.

13 Privacy

Your use of the Service is also governed by our Privacy Policy, which sets out exactly what we collect, who processes it, and how to make us delete it.
